1. Acceptance of Terms

By creating an account, accessing auditward.com, or using our services, you agree to these Terms of Service, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the platform. Your continued use of the service constitutes ongoing acceptance of these terms.

2. Service Description

AuditWard is an AI-powered platform for automated QA testing and security auditing of web applications. The service performs automated browser-based testing, security scanning (including but not limited to port scanning, SSL/TLS analysis, vulnerability detection, directory enumeration, subdomain discovery, and technology fingerprinting), and generates reports based on the findings. Scans are performed using a combination of proprietary and open-source security tools.

3. Account Registration

To use AuditWard, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account credentials. By registering, you confirm that you have read and accepted these Terms of Service and our Privacy Policy. You must verify your email address before initiating scans.

Because of the free demo and trial functionality we provide, each person may register and maintain only one account of their own for personal or trial use. We may refuse registration of, suspend, or remove additional accounts that we reasonably believe a person created to gain extra free or trial usage.

This limit covers accounts you create for yourself. It does not limit accounts you are invited to join. If an organization invites you to its workspace, you may register and keep a separate account for that workspace even if you already maintain your own account, and you may be a member of more than one workspace. Invitations are available only on our paid plans, so an account created from an invitation does not draw on the free and trial allowances that the one-account limit protects.

4. Authorization and User Responsibility

You represent and warrant that you are the owner of, or have obtained explicit written authorization from the owner of, any domain or web application that you submit for scanning through AuditWard. You acknowledge that:

• Each scan performs active security testing that may include port scanning, vulnerability probing, directory brute-forcing, and other intrusive techniques that generate network traffic to the target.
• Scanning a domain without proper authorization may violate applicable laws, including but not limited to the Computer Fraud and Abuse Act (CFAA) in the United States, the Computer Misuse Act (CMA) in the United Kingdom, and equivalent legislation in other jurisdictions.
• You bear sole and complete responsibility for ensuring you have proper authorization before initiating any scan.
• AuditWard may record and retain your authorization acknowledgment for each scan session as part of its audit trail.

4.1. Scope of Authorization

Your warranty under Section 4 extends to every system that a scan may access, not only the primary domain or application. You represent and warrant that, before initiating a scan, you hold all necessary permissions from each owner and licensor of:

• The primary domain or web application submitted for scanning.
• All content delivery network (CDN) edge servers and caching infrastructure serving the target.
• Any shared hosting environment on which the target is hosted.
• Subdomains of the target and related infrastructure hosted by third parties.
• Any other infrastructure component accessed in the course of scanning.

5. Acceptable Use Policy

You agree not to use AuditWard to:

• Scan any domain, server, or application for which you do not have explicit authorization.
• Conduct denial-of-service attacks, exploit discovered vulnerabilities, or otherwise disrupt or damage any system.
• Scan government, military, critical infrastructure, healthcare, or financial systems without documented authorization from the system owner.
• Share, distribute, or publish scan results with the intent to facilitate unauthorized access or attacks against any system.
• Create or operate additional accounts of your own to get around the one-account limit, trial allowances, or usage quotas. This does not restrict accounts you are invited to join as a member of a paid workspace.
• Circumvent rate limits, usage quotas, or other platform restrictions.
• Use the platform for any purpose that violates applicable local, state, national, or international law.

AuditWard reserves the right to suspend or terminate your account immediately if we have reasonable grounds to believe you are violating this Acceptable Use Policy.

6. Scan Disclaimers

AuditWard scan results are provided on an informational basis only. You acknowledge and agree that:

• Scan findings may contain false positives (reported issues that are not actual vulnerabilities) and false negatives (real vulnerabilities that are not detected).
• AuditWard does not guarantee the accuracy, completeness, or reliability of any scan results or reports.
• Scan results do not constitute a comprehensive security assessment, penetration test, or security certification.
• You are solely responsible for verifying, triaging, and acting upon scan findings.
• AuditWard is not a substitute for professional security audits, compliance assessments, or expert consultation.

7. Service Limitations

You acknowledge that automated security scans may:

• Trigger intrusion detection systems (IDS), web application firewalls (WAF), or other security monitoring on target systems.
• Generate significant network traffic to target domains.
• Cause temporary performance degradation on target systems in rare cases.
• Be blocked or rate-limited by the target's infrastructure.

AuditWard is not liable for any disruption, performance impact, or security alerts caused by scans that you initiate.

7.1. Acceptance of Risk from Intrusive Testing

By initiating a scan, you acknowledge and agree that:

• Scans employ intrusive techniques, including port scanning, vulnerability probing, and fuzzing, that may cause denial-of-service conditions, system crashes, service outages, or loss of data on the target and on connected systems.
• You explicitly accept the risk of such damage occurring, even where you hold proper authorization for the scan and the scan operates as intended.
• Your acceptance of this risk is a separate undertaking from your authorization warranty under Section 4 and from your decision to initiate the scan, and you give it in the knowledge that damage of the kind described above may result.
• AuditWard has no liability to you for damage caused by an authorized scan where you have consented to the risk of that damage under this Section 7.1, and nothing in Section 13 creates or preserves any such liability.

8. Indemnification

You agree to indemnify, defend, and hold harmless AuditWard, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the service, including any scans you initiate.
• Your violation of these Terms of Service or the Acceptable Use Policy.
• Your scanning of domains or systems without proper authorization.
• Any third-party claims resulting from your use of scan results.
• Your violation of any applicable law or regulation in connection with your use of the service.

8.1. Indemnity for Breach of the Authorization Undertaking

Without limiting Section 8, you agree to indemnify, defend, and hold harmless AuditWard, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to any breach of your authorization undertaking under Sections 4 and 4.1, including:

• Scans you initiated against any system for which you did not in fact hold the required permission.
• Claims brought by owners or licensors of domains, applications, CDN edge servers, hosting environments, subdomains, or other infrastructure scanned without their authorization.

9. Pricing and Billing

All pricing information displayed on this website is indicative and subject to change before and after the initial product release. AuditWard reserves the right to modify pricing, plan features, scan allowances, and overage rates at any time. Existing subscribers will be notified of pricing changes at least 30 days in advance via email.

Cancellations, refunds, and billing adjustments are governed by our Refund & Cancellation Policy.

10. Data Processing

When you use AuditWard, we collect and process the following data from scans:

• Target URLs and domain information you provide.
• Scan results, findings, evidence, and screenshots generated during scanning.
• Tool outputs and raw data from security analysis tools.
• Reports generated from scan data.

This data is stored on Amazon Web Services (AWS) infrastructure in the United States with encryption in transit and at rest. You retain ownership of your scan data. For more details, see our Privacy Policy. Where we process personal data in scan data on your behalf, our Data Processing Agreement applies.

11. API and MCP Access

Paid plans include programmatic access to the platform through the Model Context Protocol (MCP) and associated APIs, authenticated by access tokens you create in the dashboard. By using programmatic access you acknowledge and agree that:

• Access tokens are confidential credentials. You are responsible for storing them securely, and all actions performed with a token are attributed to your account as if you performed them directly.
• Scans initiated through MCP or the API are subject to the same authorization requirements, Acceptable Use Policy, plan quotas, and overage billing as scans started from the dashboard.
• You must revoke a token immediately if you suspect it has been exposed. We may revoke tokens or suspend programmatic access if we detect abuse, unusual volume, or activity that violates these terms.
• Programmatic endpoints are rate limited. Automated workloads must respect rate limits and may not be used to circumvent quotas or platform restrictions.
• When you connect third-party tools (such as AI assistants or MCP clients) to your account, you are responsible for the actions those tools take with your token and for any data they receive from the platform.

12. Intellectual Property

All content on this website, including text, graphics, logos, and software, is the property of AuditWard and is protected by applicable intellectual property laws. You retain ownership of any data you submit to or generate through the platform.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• AuditWard and its services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• AuditWard does not warrant that the service will be uninterrupted, error-free, or that scan results will be accurate or complete.
• In no event shall AuditWard be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the service.
• AuditWard's total aggregate liability for all claims arising from or related to the service shall not exceed the amount you paid to AuditWard in the twelve (12) months preceding the claim.

14. Termination

AuditWard may suspend or terminate your account at any time for violation of these terms or the Acceptable Use Policy, with or without notice. Upon termination, your right to use the service ceases immediately. Sections 4, 6, 8, 11, and 13 survive termination.

15. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Delaware.

16. Changes

We reserve the right to modify these terms at any time. Material changes will be communicated via email to registered users at least 30 days before they take effect. Continued use of the service after changes become effective constitutes acceptance of the updated terms.
